The Service is operated by Theme Health, Inc., a Delaware corporation (“Theme Health,” “we,” “us,” or “our”).
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1) What Theme Health is
Theme Health is designed to help people managing chronic conditions reduce trial and error between doctor visits by turning personal inputs and optional connected signals into practical guidance and learning over time.
The Service may include:
early access / waitlist forms
prompts, check-ins, summaries, and educational content
optional community contribution features
optional integrations with third-party services (such as device and wearable platforms)
2) Not medical advice
Theme Health does not provide medical advice, diagnosis, or treatment. The Service is for informational and supportive purposes only.
You should always seek the advice of a qualified healthcare professional with any questions regarding a medical condition. Never disregard professional medical advice because of something you read or use in the Service.
No emergency use
Do not use Theme Health for emergencies. If you believe you are experiencing an emergency, call 911 (or your local emergency number) immediately.
3) Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.
4) Early access, alpha, and beta
If you are using an early access, alpha, or beta version of the Service:
features may change, be removed, or be incomplete
the Service may contain bugs or interruptions
we may limit access, pause features, or discontinue early access at any time
You understand that early access is provided “as is” and may not be reliable.
5) Accounts and communications
Some features may require you to create an account. You agree to provide accurate information and keep it updated.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
By providing your email address, you agree that we may contact you about:
early access invitations and onboarding
product updates and changes
administrative or support messages
You can opt out of marketing emails, but we may still send important service-related messages.
6) Your responsibilities
You agree to:
use the Service only for lawful purposes
not attempt to reverse engineer, scrape, disrupt, or abuse the Service
not use the Service to harm others or violate privacy or security
not submit content that is illegal, harassing, hateful, or deceptive
We may suspend or terminate your access if we believe you violated these Terms.
7) Community features and user content
The Service may allow you to submit information, text responses, ratings, or other content (“User Content”), including community responses.
You own your User Content
You retain ownership of your User Content.
License you grant to Theme Health
By submitting User Content, you grant Theme Health a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and process your User Content as needed to operate and improve the Service, including creating aggregated or de-identified insights.
We handle personal information as described in our Privacy Policy.
You are responsible for what you submit
You represent that you have the right to submit your User Content and that it does not violate any law or third-party rights.
8) Privacy

9) Third-party services and integrations
The Service may connect to third-party services (for example: Apple Health, Health Connect, wearable platforms). Your use of third-party services is governed by their terms and policies. Theme Health is not responsible for third-party services and does not control their performance, availability, or data practices.
10) Intellectual property
The Service, including its software, design, text, graphics, logos, and other content (excluding User Content), is owned by Theme Health and protected by intellectual property laws.
You may not copy, modify, distribute, sell, lease, or create derivative works from the Service unless we give you written permission.
11) Feedback
If you provide suggestions, ideas, or feedback, you grant Theme Health the right to use it without restriction or compensation, including to improve the Service.
12) Paid features (if introduced later)
Some features may become paid. If we introduce paid features, we will clearly present the pricing and terms before you purchase. All payments are non-refundable unless otherwise stated or required by law.
13) Suspension and termination
We may suspend or terminate your access at any time if:
you violate these Terms
we believe your use creates risk or legal exposure
we discontinue the Service or early access
You may stop using the Service at any time.
14) Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEME HEALTH DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that any outcome will result from using the Service.
15) Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
THEME HEALTH WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
THEME HEALTH’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO THEME HEALTH FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR $100 IF YOU PAID NOTHING
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
16) Indemnification
You agree to indemnify and hold harmless Theme Health and its officers, directors, employees, and contractors from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from:
your use of the Service
your User Content
your violation of these Terms or applicable law
17) Governing law and venue
These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws rules.
Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction.
18) Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, provide notice. Your continued use of the Service after changes means you accept the updated Terms.
